Key responsibilities include:
• The effective management of all medical legal matters in accordance with legal requirements
• Liaise with legal counsel, experts, staff members and other relevant role players on all legal matters
• Co-ordinate and facilitate collaboration between the multi-disciplinary medical team to ensure that clinical investigations are efficient and effective
• Provide a clear strategy with regards communication to lawyers, insurers and other relevant role-players.
• Ensure that all medical legal records are maintained and compile reports for the insurance companies.
• Provide day-to-day legal advice on the management of clinical events and complaints and conduct risk assessments as per procedure
• Manage pre-litigation claims, calculate damages, and negotiate settlements in line with insurance policy requirements and sound legal practice
• Overall responsibility for risk management by identifying trends from legal action and incidents and develop quality improvement initiatives to prevent reoccurrence
• Educate staff on legal risks and advise on the appropriate actions to be implemented as preventative measures
• Pro-active management of the organization’s liability portfolio, insurance brokers and insurers
• Regular analysis of payment statistics and feedback on legal advice to identify trends and suggest leading practices as a quality improvement measure
• Assist other functional departments with the review and interpretation of all medical legal documentation
• Represent the company at relevant legal proceedings as and when required
• Continuous monitoring, interpretation, analysis and implementation of legislation and regulatory guidelines to ensure good corporate governance
• A formal legal qualification with at least 5-8 years relevant experience within a medical legal department
• In-depth knowledge of healthcare legislation, medical- and case law and ethical rules and responsibilities
• A basic knowledge of all relevant legislation applicable to business. Assist in developing effective internal controls designed to promote adherence with applicable laws; HAAD/MOH/DHA requirements and UAE based health plans
• Basic knowledge of medical terminology, physiological processes and medical and surgical procedures is recommended
• Sound knowledge of company insurance framework and insurance policy requirements
• Proven experience with researching the quantum of damages and conversions to current financial value
• Ability to pay meticulous attention to detail resulting in accurate work processes
• Strong preference for making complex decisions and advising senior leadership on appropriate action
• The ability to present and communicate information in a concrete manner to internal clients and provide guidance on risk mitigating practices
• The ability to communicate with and relate to all internal and external clients at all levels of the organization
